We at Cloudtaxi want you to feel safe from booking to landing and for us to be able to say goodbye to you with a big smile. Our terms and conditions contain all important information on the conclusion of the contract, payment, revocation, liability and data protection. Please read them carefully before making a booking. General Terms and Conditions (GTC) of the paragliding company Cloudtaxi

General information

Cloudtaxi offers passenger flights with hang gliders (paragliders). The flights are carried out by employed or contracted pilots. However, the contractual relationship exists between the passenger and Cloudtaxi. By making a booking, the passenger confirms that they have read, understood and accepted these GTC.

Conclusion of contract and severability clause

The contract between the parties comes into effect with the binding booking by the passenger. In the event that individual provisions of these GTC should be wholly or partially void or ineffective, the validity and effectiveness of the remaining provisions shall remain unaffected.

Payment and vouchers

No flight ticket will be issued. The names of the contracting parties (Carrier and Passenger) and the fare paid are stated in the correspondence at the time the contract is concluded. The fare must always be paid in advance in cash, online or by credit card, unless expressly agreed otherwise. Special agreements will be made regarding the issue, crediting and validity of vouchers, which will be noted on the voucher. In the event of loss of a voucher and the associated number, no claim for compensation can be made to protect against misuse.

Pilot and equipment

The pilot in charge of the passenger flight is in possession of the necessary official license. The pilot is the commander of the biplace hang glider and the passenger undertakes to follow his instructions. The hang glider used is suitable for passenger flights and is properly maintained. The pilot carries a rescue device (emergency parachute).

Health and equipment of the passenger

The passenger confirms that he/she does not suffer from any health problems (mental or physical) that could affect the safe operation of a passenger flight with a hang glider. In case of doubt, he/she will inform the pilot at the latest during preparations for take-off. In such a case, a joint decision should be made as to whether the passenger flight can be carried out. The final decision lies with the pilot. The passenger undertakes to wear a suitable Helmet, or one provided by the pilot and sturdy footwear. The pilot may impose additional requirements (e.g. long pants, warm clothing, etc.).

Exclusion of liability

Cloudtaxi's liability for bodily injury and property damage incurred by the passenger during a hang glider flight is expressly excluded. In particular, Cloudtaxi shall not be liable for the actions of the arranged organizers and their assistants.

Underage or incapacitated passengers

Minors or incapacitated passengers require the consent of a holder of parental authority or a legal representative. If such a person is not present at the time of the flight, a written declaration of consent must be submitted in advance.

Date, place of execution, duration and cancellation by the organizer

Dates for passenger flights are agreed in advance (even at short notice). Changes to the date of the flight may be necessary due to weather conditions or for organizational reasons. The pilot makes the final decision as to whether or not a passenger flight is possible. If possible, the passenger flight will be postponed to the next available date. If an alternative date is not possible and the reasons for the cancellation of the original date do not lie with the passenger, the passenger may demand a refund of the fare paid. The duration of a passenger flight depends on the meteorological conditions. If the passenger has been promised a minimum duration of the flight and this could not be achieved, the passenger may reclaim the difference in the flight price pro rata to the actual flight time promised. Further claims against the organizer are excluded.

Cancellation by the passenger

If the passenger cancels the flight even though it would have been possible, the following rules apply to the refund of the fare:

(a) In the event of cancellation up to two days before the first agreed date, the full fare will be refunded.

b) In the event of cancellation less than 48 hours before the date, 50% of the fare will be refunded.

c) In the event of cancellation on the day of the scheduled flight, the fare paid will not be refunded.

The following deadlines apply to group events: a) 7 days b) 7 days c) 2 days before

Insurance

The passenger confirms that he/she is insured against the consequences of an accident (including during a hang-gliding flight). Cloudtaxi does not provide accident insurance. The pilot has taken out liability insurance with a maximum cover of CHF 5 million. The pilot's liability for bodily injury and property damage suffered by the passenger during a hang gliding flight is limited to a maximum of this amount.

Photography and filming

The passenger is permitted to carry a small compact camera (GoPro type). This must be properly attached. The pilot decides on the type and method of attachment. Cell phones and cameras with interchangeable lenses may not be used during the flight. The pilot may allow exceptions to this under (safety) conditions.

Jurisdiction for passengers from the USA or Canada

Passengers from the USA or Canada expressly waive the right to a place of jurisdiction in the USA or Canada for any disputes arising from the passenger flight and acknowledge that neither Cloudtaxi nor the pilot agree to a place of jurisdiction in the USA or Canada. Ordinary place of jurisdiction and applicable law. The ordinary courts at Cloudtaxi's registered office shall have jurisdiction for all disputes arising from the passenger flight contract. Swiss law shall apply exclusively.
